Terms and Conditions (T&Cs)

1) Seller identification

These Terms and Conditions of Sale are offered by:

VAT: VAT not applicable (VAT exemption scheme) – Article 293 B of the French General Tax Code (CGI).

2) Purpose, scope and definitions

These T&Cs govern the sale of living plants/plant products (hereinafter “Products”) concluded via the Website between the seller (hereinafter “the Seller”) and any buyer (hereinafter “the Customer”).

Sales are intended for:

  • consumers (B2C),
  • and professionals (B2B).

Consumer mediation provisions (Article 14) apply only to consumers.

Delivery: France and the European Union (intra-Community), according to the options offered at the time of ordering.

Placing an order implies full and unconditional acceptance of the T&Cs in force on the date of purchase.

3) Products (living plants) – information

Products sold are living beings. Their appearance may vary depending on:

  • the season (budbreak, maturity, dormancy),
  • climatic conditions,
  • cultivation and pruning,
  • natural variability.

Photos are non-contractual. Indicated dimensions (height, width, age, grade, container) are for information only.

4) Availability

Offers are valid while stocks last.

In the event of unavailability after the order has been validated, the Seller will inform the Customer as soon as possible and will offer, at the Customer’s choice:

  • a refund for the unavailable product,
  • or, with the Customer’s agreement, an equivalent product / store credit.

5) Prices

Prices are shown in euros.

Unless otherwise stated, prices displayed on the Website are all taxes included (VAT not applicable – Art. 293 B of the CGI).

Shipping costs are indicated before final validation of the order and are added to the price of the Products.

6) Order

The Customer places an order online. The order is considered final after:

  1. validation of the cart and contact details,
  2. acceptance of the T&Cs,
  3. payment confirmation (or validation depending on the chosen method).

The Seller reserves the right to refuse or cancel an order in the event of a previous dispute, manifestly incorrect information, or suspected fraud.

7) Payment

7.1 Consumer customers (B2C)

Payment is made using the methods offered on the Website, including:

  • bank card via Stripe,,
  • and, if available on the Website at the time of purchase, PayPal.

The order is processed after payment confirmation by the payment service provider.

7.2 Professional customers (B2B)

Unless otherwise agreed in writing, payment is due at the time of ordering (methods offered on the Website).

In case of late payment (notably if an invoice or deferred payment has been granted in writing), late payment penalties are due automatically, as well as a fixed recovery fee of €40 (per invoice); the Seller reserves the right to request additional compensation if recovery costs exceed this amount.

8) Delivery / pickup

8.1 Served areas

Delivery in France and the European Union (intra-Community), subject to eligibility and shipping methods offered at the time of ordering.

8.2 Terms and indicative timeframes

Timeframes are indicative. Shipments of living plants may be adjusted (postponed, grouped) in the event of unfavourable conditions (frost, heatwaves, extreme events) in order to preserve quality upon arrival.

8.3 Delivery address

The Customer is responsible for the accuracy of the address provided. In the event of an error (incomplete address, missing access code, etc.), any reshipment or return costs may remain at the Customer’s expense.

8.4 Receipt – essential checks

The Customer must check the parcel at the time of delivery and unpack the plants promptly.

In case of an issue (damaged parcel, damaged product, missing item, wrong item), the Customer must:

  • make specific reservations with the carrier if necessary,
  • and contact customer service at infos@pepinieredurenard.fr within a maximum of 24 hours after receipt, with photos (parcel, label, packaging/padding, product).

After this time, claims related to transport damage or condition on arrival may be refused.

8.5 Transfer of risk

Risks of loss or damage are transferred to the Customer when they take physical possession of the Products (or at a pickup point, upon handing over to the Customer).

9) Right of withdrawal

9.1 Consumer customers (B2C)

In distance selling, the consumer in principle has a 14-day right of withdrawal.

9.2 Exception – goods likely to deteriorate quickly

In accordance with the French Consumer Code, the right of withdrawal does not apply in particular to goods likely to deteriorate or expire rapidly. As living plants fall into this category, the right of withdrawal is excluded for shipped plants.

9.3 Professional customers (B2B)

For professional customers, there is no right of withdrawal applicable to purchases made via the Website.

As an exception, certain protective rules may apply only to contracts concluded off-premises between professionals when (i) the object of the contract does not fall within the main activity of the professional solicited and (ii) the professional employs no more than 5 employees (Article L221-3 of the French Consumer Code).

10) Statutory warranties

The Customer benefits from the applicable statutory warranties.

Given the living nature of plants, establishment and development also depend on external factors (soil, watering, exposure, repotting/planting, temperatures, post-transport stress). The Seller cannot be held liable for decline linked to unsuitable growing conditions after receipt.

11) Customer service (after-sales) – claims

Any request must be sent to infos@pepinieredurenard.fr , mentioning the order number and describing the issue precisely, with photos if necessary.

For incidents related to transport and condition upon receipt: maximum timeframe 24 hours after receipt (Article 8.4).

12) Liability

The Seller is bound by an obligation of means regarding preparation and packaging of orders.

The Seller cannot be held liable in the event of:

  • delays attributable to the carrier,
  • Customer absence at delivery / failure to collect at a pickup point,
  • force majeure,
  • incorrect planting/care or unsuitable growing conditions after receipt.

13) Personal data

Personal data are processed in accordance with the Website’s Privacy Policy / Cookies Policy.

14) Consumer mediation (B2C only)

In accordance with the French Consumer Code, the consumer may use a consumer mediator free of charge to resolve a dispute amicably. The Seller provides the consumer with the details of the competent mediator.

15) Governing law – disputes

These T&Cs are governed by French law.

In the event of a dispute, the Customer is invited to contact the Seller first to seek an amicable solution. Failing this, the consumer Customer may use mediation (Article 14).

16) Intellectual property

All elements of the Website (texts, photos, logos, graphics) are protected. Any total or partial reproduction without prior written authorisation is prohibited.
